1. Agreement to Terms
Welcome to Available Jobs. By accessing or using our website and services ("Services"), you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree to these Terms, please do not use our Services.
We reserve the right to modify these Terms at any time. Any changes will be effective immediately upon posting. Your continued use of the Services after changes are posted constitutes your acceptance of the revised Terms.
2. Description of Services
Available Jobs is a job search and career development platform that provides:
- Access to job listings from various companies and industries
- Company profiles and information
- CV/Resume screening and ATS scoring using AI technology
- Career advice and resources through our blog
- User accounts for managing job applications and CV scans
3. User Accounts
3.1 Account Registration
To access certain features of our Services, including CV screening, you must create an account. You agree to:
- Provide accurate, current, and complete information during registration
- Maintain and promptly update your account information
- Maintain the security of your password and account
- Accept responsibility for all activities that occur under your account
- Notify us immediately of any unauthorized use of your account
3.2 Email Verification
You must verify your email address before accessing certain features. We may suspend or terminate accounts with unverified email addresses.
3.3 Account Termination
We reserve the right to suspend or terminate your account at any time, with or without notice, for violation of these Terms or any other reason we deem appropriate.
4. User Conduct and Responsibilities
You agree NOT to:
- Use the Services for any illegal or unauthorized purpose
- Violate any laws in your jurisdiction (including copyright laws)
- Upload or transmit viruses, malware, or any harmful code
- Attempt to gain unauthorized access to our systems or other users' accounts
- Interfere with or disrupt the Services or servers
- Collect or harvest any information from the Services using automated means
- Impersonate any person or entity, or falsely represent your affiliation
- Upload false, misleading, or fraudulent CVs or information
- Use the Services to spam, harass, or abuse other users
- Reverse engineer, decompile, or disassemble any part of the Services
5. CV Screening Service
5.1 Service Description
Our CV screening service uses artificial intelligence (OpenAI GPT-4) to analyze your CV and provide an ATS (Applicant Tracking System) compatibility score along with improvement suggestions.
5.2 No Guarantees
The CV screening service is provided for informational purposes only. We do not guarantee:
- That the feedback will improve your job prospects
- The accuracy or completeness of the AI-generated analysis
- That following our recommendations will result in job offers
- That our scoring matches any specific company's ATS system
5.3 Content Ownership
You retain all ownership rights to your CV content. By uploading your CV, you grant us a limited license to process, analyze, and store it for the purpose of providing our Services.
5.4 Rate Limits
We may impose rate limits on CV scans to prevent abuse and ensure fair access for all users. Authenticated users receive higher limits than anonymous users.
6. Job Listings
Job listings on Available Jobs are provided by third parties (employers or recruiters). We:
- Do not verify the accuracy of job listings
- Are not responsible for the hiring decisions of employers
- Do not guarantee that listed positions are currently available
- Are not party to any employment relationship between you and employers
You should conduct your own due diligence before applying to any job or sharing personal information with employers.
7. Intellectual Property
7.1 Our Content
All content on Available Jobs, including but not limited to text, graphics, logos, images, software, and design, is owned by or licensed to Available Jobs and is protected by intellectual property laws. You may not copy, reproduce, distribute, or create derivative works without our express written permission.
7.2 User Content
By uploading content (including CVs), you represent and warrant that you own or have the necessary rights to such content and that it does not infringe any third-party rights.
8. Third-Party Services and Links
Our Services may contain links to third-party websites or integrate with third-party services (including job application portals, OpenAI, Supabase, and hCaptcha). We are not responsible for:
- The content, privacy policies, or practices of third-party sites or services
- Any damages or losses caused by your use of third-party services
- The availability or performance of third-party services
Your use of third-party services is at your own risk and subject to their terms and policies.
9. Disclaimers
THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:
- Warranties of merchantability, fitness for a particular purpose, or non-infringement
- Warranties regarding the accuracy, reliability, or completeness of content
- Warranties that the Services will be uninterrupted, secure, or error-free
- Warranties regarding the results obtained from using the Services
We do not warrant that defects will be corrected or that our Services are free of viruses or other harmful components.
10. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, AVAILABLE JOBS AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND AFFILIATES SHALL NOT BE LIABLE FOR:
- Any indirect, incidental, special, consequential, or punitive damages
- Loss of profits, revenue, data, or use
- Loss of or damage to property
- Damages arising from your use or inability to use the Services
- Damages arising from any third-party content or conduct
Our total liability to you for all claims arising from your use of the Services shall not exceed the amount you paid us in the twelve (12) months prior to the claim, or ZAR 100, whichever is greater.
11. Indemnification
You agree to indemnify, defend, and hold harmless Available Jobs and its officers, directors, employees, agents, and affiliates from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or in any way connected with:
- Your access to or use of the Services
- Your violation of these Terms
- Your violation of any third-party rights, including intellectual property rights
- Any content you submit or upload to the Services
12. Governing Law and Dispute Resolution
12.1 Governing Law
These Terms shall be governed by and construed in accordance with the laws of South Africa, without regard to its conflict of law principles.
12.2 Jurisdiction
Any disputes arising out of or relating to these Terms or the Services shall be subject to the exclusive jurisdiction of the courts of South Africa.
12.3 Informal Resolution
Before filing any formal legal action, you agree to first contact us at cv@availablejobs.co.za to attempt to resolve the dispute informally.
13. Privacy
Your use of the Services is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Please review our Privacy Policy to understand how we collect, use, and protect your information.
14. Severability
If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable.
15. Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and Available Jobs regarding the use of our Services and supersede all prior agreements and understandings.
